AFFILIATE PROGRAM TERMS

These Affiliate Program Terms (the “Terms”) govern your participation in the Hostingio affiliate program (the “Program”). Hostingio is operated by Proactivity Group Limited, a company registered in Hong Kong (“we”, “us”, “our”). By enrolling in or participating in the Program you (“Affiliate”, “you”) agree to these Terms. If you do not agree, do not enrol.
1. Eligibility & Enrolment
- You must hold an active client account in our billing system and be at least 18 years old (or the age of majority in your jurisdiction).
- Enrolment is subject to manual review and approval. We may approve, reject, suspend or remove any Affiliate at our sole discretion.
- You are responsible for the accuracy of your account and payout details.
2. Commissions
- You earn 10% recurring commission on the net recurring service fees paid by customers you refer, for as long as the referred account stays active and in good standing while you remain an approved Affiliate.
- Commission applies to recurring service fees only. One-off and add-on charges are excluded, including setup fees, additional IP addresses, extra bandwidth or traffic packages, software licenses and manual work.
- Discounts, coupons, credits and taxes are deducted before commission is calculated.
- We may change commission rates or plan structure prospectively; changes do not affect commissions already approved.
3. Tracking & Attribution
- Referrals are tracked via your unique referral link using cookies, on a last-click basis.
- The tracking window is 60 days from the visitor's last click. A referral qualifies if the customer signs up and places a paid order within that window.
- Our billing system's tracking is the system of record. Referrals that cannot be attributed to your link do not qualify.
- Tracking is subject to applicable law, browser settings and the visitor's cookie preferences. We do not guarantee that every referral will be successfully tracked.
4. Approval, Reversals & Payouts
- Commissions are held and confirmed approximately 30 days after each qualifying payment, covering our 14-day money-back window and fraud checks.
- If a referred payment is refunded, charged back, reversed or found fraudulent, the related commission is cancelled or clawed back from your balance.
- Approved commissions accrue as account credit. Withdrawals may be requested once your approved balance reaches $50, subject to verification.
- We may withhold or delay payment where we reasonably suspect fraud, abuse or a breach of these Terms.
5. Prohibited Practices
You must not:
- Refer yourself or accounts you control (self-referral), or create orders solely to earn commission.
- Use spam (email, messaging, comments), misleading claims or unsolicited advertising.
- Bid on our trademarks or brand terms in paid search, or use domains/usernames that impersonate us (typosquatting, cookie-stuffing, forced clicks).
- Misrepresent pricing, features or your relationship with us, or make promises on our behalf.
- Offer unauthorised cash incentives, rebates or coupon schemes that violate applicable law or our policies.
Breach may result in withheld or reversed commissions and immediate termination.
6. Use of Brand & Materials
We grant you a limited, non-exclusive, revocable licence to use our name, logo and approved marketing materials solely to promote the services under these Terms. You must follow any brand guidelines we provide, must not modify the materials in a misleading way, and must not present yourself as our employee, agent or anything beyond an independent affiliate. All goodwill from such use belongs to us. The licence ends when your participation ends.
7. Term & Termination
- Either party may terminate participation at any time, for any reason, with notice.
- On termination without breach, commissions already approved remain payable; pending and future commissions stop accruing.
- On termination for breach, fraud or abuse, unpaid commissions may be forfeited.
- No commissions accrue on payments received after termination.
8. Relationship & Taxes
You participate as an independent contractor. Nothing in these Terms creates an employment, partnership, agency or joint-venture relationship. You are solely responsible for all taxes, duties and reporting arising from commissions you receive.
9. Disclaimers & Liability
The Program is provided “as is”, without warranties of any kind. To the maximum extent permitted by law, our total liability arising from the Program is limited to the unpaid, approved commissions owed to you. We are not liable for indirect, incidental or consequential damages.
You will indemnify us against third-party claims, regulatory penalties and reasonable costs arising from your breach of these Terms, unlawful marketing activities, misleading statements, or infringement of third-party intellectual property or privacy rights.
10. Changes
We may update these Terms from time to time. The current version is always published on this page with its effective date. Continued participation after changes take effect constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of Hong Kong SAR, and any dispute is subject to the exclusive jurisdiction of the courts of Hong Kong.
